Heroin is a powerful narcotic and, like with methamphetamine, law officials in the State of Texas take even simple possession as a very serious felony offense. Because the heroin problem is so rampant, there are some jurisdictions that may offer drug diversion programs rather than jail time to first-time offenders.
Regardless, being caught with any amount of heroin in Texas is a felony offense. Although there will likely still be bail options available, know that the courts frown upon the use or distribution of hard drugs and may impose the highest possible bail amount under the law.
As we mentioned, there are a few opportunities for individuals charged with possession of heroin to undergo treatment programs rather than jail. This is done on a person-by-person basis, and the courts rigorously assess the qualifications of each offender.
The majority of offenders will face stiff penalties. Less than one gram of heroin in your possession is a state jail felony. That’s punishable by 180 days to two years in jail. Possession of between one and four grams is a third-degree felony and offenders can face anywhere from two to 10 years in prison. The same goes for possession of heroin between four to 200 grams, except it becomes a second-degree felony and the maximum time is bumped from 10 to 20 years.
When you start getting into possession over 200 grams, offenders can face up to life in prison. Heroin possession is that serious. Similar laws exist for possession with intent to distribute. One of the main differences is in the amount you can be fined; the fine can go up to $250,000 for the most serious sale offenses as opposed to $100,000 for possession.
