Types of Misdemeanors

In the state of Texas, misdemeanors have a wide range of possible offenses split among the three categories. Some of the misdemeanors in each class include the following:

Class A Misdemeanors

  • DWI (second offense)
  • Possession of two to four ounces of marijuana
  • Unlawfully carrying of a weapon
  • Theft over $500 but under $1,500

Class B Misdemeanors

  • DWI (first offense)
  • Possession of under two ounces of marijuana
  • Theft under $500 and over $50.00

Class C Misdemeanors

  • Public intoxication
  • Disorderly conduct
  • Simple assault
  • Traffic tickets

Although these crimes are less severe than those considered felonies, defendants are given the same right to trial if they so choose. They will be placed in front of a jury of six who must unanimously agree on the defendant’s guilt or innocence. Typically, misdemeanor cases do not go to a full trial; a probation period is usually given if the defendant is found guilty, along with fines and community service.

Jail time is only possible with class A and class B misdemeanors. The maximum fine is for a class A misdemeanor, which can be up to $4,000. Bail for misdemeanors are typically much more affordable than that of a felony, in addition to the charges being less serious, and are therefore easier to process. There is a statute of limitations for misdemeanors, with the defendant having to be charged within two years of having committed the crime.
