Couch, who was 16 when he was accused of drunk driving, which lead to the death of four people, arrived back in Fort Worth on Thursday, January 28, 2016 after fleeing his bail and being detained in Mexico since December. The local sheriff said he is currently being detained at Tarrant County juvenile detention center. Reports show he did not give any problems and was calm during the process. Prior to fleeing his bail, a psychiatrist had claimed he suffered from “affluenza”—a term created to refer to those who come from affluent families and are so spoiled that they aren’t able to distinguish right from wrong. “People really made a big deal about this diagnosis by the psychiatrist because it’s not something that is recognized by the American Psychiatric Association,” says Paul Schuder, owner of PCS Bail Bonds. “I think the general public’s opinion is that this type of claim is dangerous and removes any responsibility from the defendant.”
Couch faces up to four months in prison should he be found guilty of breaching his probation. His mother could face up to 10 years in prison for her role in helping her son escape to Mexico. In an interesting twist, Couch’s lawyers are hoping to have him transferred to an adult prison so they can seek bail.
“The option for bail isn’t possible in the juvenile system,” Schuder continues. “So, although it may seem odd that his lawyers would voluntarily move him to the adult jail, it’s a move they feel would work out to his benefit in the short term.”
